Article 36 The inspection and quarantine institutions shall in accordance with national environmental protection control standards and procedures at the port of entry inspection and quarantine of imported waste materials for health and quarantine, animal and plant quarantine, environmental projects and other items of inspection and quarantine inspection.

Chapter VI Supervision and Administration

Article 39 The foreign suppliers and domestic consignee shall ensure compliance with the registration requirements, to carry out the scope of supply in accordance with the registration, import and other activities.

Article 42 AQSIQ implementation of imported waste materials A, B, C three types of early warning management:

 (A) on the need to eliminate the foreign suppliers and domestic consignee registration, or from a specific country / region specific categories of waste materials imported, AQSIQ issued Class A warning, inspection and quarantine agencies no longer accept the relevant inspection applications;

(Two) on foreign suppliers to offer domestic consignees import or from specific countries / regions, specific categories of imported waste materials taken measures tightened inspection, AQSIQ issued Class B warning, inspection and quarantine authorities in the relevant full implementation of waste materials testing; consignee of imports on the domestic waste materials tightened inspection measures taken can also be directly under the Inspection and Quarantine issued by the Class B warning, inspection and quarantine agencies within its jurisdiction for the implementation of the relevant waste materials full inspection;

(Three) on environmental projects failed or other risk control measures to be taken to the waste materials, the State Administration of Quality Supervision, Inspection and Quarantine agency issued or Class C warning, port inspection and quarantine agencies should pay close attention to the warning period warning goods and their carrying tools trends, warning against triggering Class C waste materials related to the implementation of full inspection.

Article 43 The foreign supplier of the following circumstances trigger the warning category B, the inspection and quarantine agencies to its output of waste materials implement a 90-day full inspection:

(A) Within one year goods fail to match or cumulative environmental projects failed more than three batches (including three batches) of;

(Two) and has a larger epidemic substandard quarantine risk;

(Three) in accordance with the provisions of Article 47 Measures to be revoked after regaining registered;

(Four) on-site inspection found defective quality control system.

Article 44 of the following circumstances occur domestic consignees Class B trigger warning, inspection and quarantine of imported waste materials bodies on their implementation period of 90 days full inspection:

(A) there is a serious waste materials imported goods fail to match, inaccurate reporting, and upon inspection indeed domestic consignees responsibility;

(Two) the registration of domestic consignees content changes, not directly under the Inspection and Quarantine Bureau within the prescribed period of change procedures;

(Three) within one year of the first occurrence of imported waste materials environmental projects failed inspection, upon inspection indeed domestic consignees responsibility;

(Four) on-site inspection found defective quality control system;

(Five) in accordance with the provisions of Article 48 Measures revoked regain registered.

Chapter VII Legal Responsibility
