Import and Export Inspection and Quarantine of feed and feed additives, supervision and management methods
Chapter I General Provisions
First to regulate the import and export feed and feed additives inspection and quarantine supervision and management, import and export of feed and feed additives to improve safety, protect animal and human health, according to "Entry and Exit Animal and Plant Quarantine Law" and its implementing regulations, "Republic of China Import and Export Commodity Inspection Law" and its implementing regulations, "the State Council on strengthening food and product safety supervision and management of special provisions" and other relevant laws and regulations, formulated.
These Measures shall apply to the import, export and transit of feed and feed additives (hereinafter referred to as feed) the inspection and quarantine supervision and management.
For feed use of plants and animals and their products in accordance with the provisions of this management approach.
Feed additives, drugs do not apply these measures.
Article of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ) of the unified management of national import and export inspection and quarantine and supervision of feed management.
AQSIQ in the entry-exit inspection and quarantine agencies around (hereinafter referred to as inspection and quarantine institutions) is responsible for the import and export feed their areas of jurisdiction and supervision inspection and quarantine work.
Risk Management Chapter
Article AQSIQ import and export feed on the implementation of risk management, including risk analysis, based on the implementation of import and export feed products risk classification, business classification, review of the regulatory system, risk control, risk warnings and other measures.
Article import and export inspection and quarantine agencies in accordance with the risk level of feed products, take a different mode of inspection and quarantine supervision and dynamically adjusted.

Chapter III Import Inspection and Quarantine
Registration Section
Article AQSIQ allow the import of feed for the country or region of production enterprises to implement the registration system, registration of imported feed should come from overseas manufacturers.
Article XI shall comply with foreign manufacturers exporting country or regional laws, regulations and standards requirements, and meet with Chinese laws and regulations and standards equivalent to the requirements, the exporting country or regional authorities, after passing the examination to the State Administration of Quality Supervision recommended. (B) Registration Information: Register the product name, main raw material, use, etc.;
(C) official documents: the companies have recommended that the competent authority, and its products in the exporting country or region to allow free sale.
Article 12 The State Administration of Quality Supervision recommended materials should be reviewed.
Review failed to notify the exporting country or regional authorities to make corrections.
Review of qualified, with the exporting country or regional authorities, after consultation, the State Administration of Quality Supervision send experts to feed the exporting country or region of its security monitoring system to review and apply for registration of companies to conduct random checks. Article 13 Registration is valid for 5 years.
Needs to be extended outside the manufacturer, by the exporting country or regional authorities in the six months before the expiry of the extension of the AQSIQ. If necessary, the State Administration of Quality Supervision can send experts to the exporting country or region of its feed safety control system for retrospective review, and apply for an extension of the foreign manufacturer to conduct random checks on the spot and meet the requirements of other applications are not random extension of foreign manufacturers, the registration extended for five years.

Section Inspection and Quarantine
Article XV need for imported feed, animal and plant quarantine entry permit shall be in accordance with relevant provisions of the animal and plant quarantine permit for entry.

Article XVII inspection and quarantine agencies in accordance with the following requirements to implement the inspection and quarantine on imported feed:
(A) the Chinese laws and regulations, national standards and the mandatory provisions of the State Administration of Quality Supervision, Inspection and Quarantine requirements;
(B) bilateral agreements, protocols, memoranda;
(C) "Entry Animal and Plant Quarantine Permit" specified requirements.
Article 18 The inspection and quarantine agencies in accordance with the following provisions for imports of feed-the-spot inspection:
(A) check the cargo certificate: check the documents with the name, number (weight), packaging, production date, container number, the exporting country or region, the production company name and registration number, etc. are matched;
(B) check the label: the label is in line with national standards for feed labeling;
(C) sensory examination: packaging, container is intact, whether more than shelf life, with or without spoilage, whether carrying pests, with or without soil, animal carcasses, animal waste and other materials prohibited from entering.
Article 19 on-site inspection of the following circumstances, the inspection and quarantine agencies to issue "notice of inspection and quarantine treatment" by the owner or his agent under the supervision of inspection and quarantine institutions shall be returned or destroyed:
(A) are not included in the exporting country or region of the country or region to allow the import list;
(B) from non-registered foreign manufacturers of products;
(C) the registration of foreign manufacturers from non-registered products;
(D) permit the goods inconsistent;
(E) label does not meet the standards and can not be corrected;
(F) over the shelf life or spoilage;

Article 22 The competent inspection and quarantine, inspection and quarantine agencies to issue "proof of entry inspection and quarantine of goods" to be released.

Supervision and Management Section
Article 25 The import of feed should have a Chinese label on the packaging, labels, labels should be in line with national standards for Chinese feed.

Chapter IV Exit Inspection and Quarantine
Registration Section
Article 30 The State Administration of Quality Supervision on the export of feed production for export enterprises to implement the registration system, the export feed should come from registered export producers.

10 quality and safety of emergency management system.
(E) The State Administration of Quality Supervision developed by the types of feed products of export inspection and quarantine requirements.
Article 32 to the location of export production enterprises should apply for registration directly under the Inspection and Quarantine Bureau, and submit the following materials (3 copies):
(A) "export feed production, processing, inspection and quarantine storage business registration application form";
(B) the business license (copy);
(C) the organization code certificate (copy);
(D) the competent authorities for review of the national feed, the production license, product approval number and other requirements, to provide the relevant documents have been approved;
(E) involving environmental protection, environmental protection departments above the county level shall provide a certificate issued documents;
(F) Article 31 (d) to require the management system;
(Vii) the production flow chart, and indicate the necessary process parameters (except those involving trade secrets);
(H) factory layout and color photos (including the picture of the factory, the factory gate, the main equipment, laboratories, library materials, packaging and place, finished products, sample storage location, file save location, etc.);
(I) apply for registration of products and raw materials inventory.
Inspection and Quarantine Bureau directly under Article 33 shall review the application materials in a timely manner, according to the following 5 days to accept or not accept a decision and notify the applicant in writing:
(A) the application materials can be corrected on the spot the error, allowing the applicant on the spot corrections;
(B) the application materials are incomplete or do not meet the statutory form, on the spot or within five days inform the applicant in writing correction of all content, fails to do so, since the date of receipt of the application materials shall be accepted;
(C) the application materials are complete and meet the statutory requirements of the form or the applicant to submit all the supplementary application materials, shall accept the application.
Inspection and Quarantine Bureau directly under Article 34 should be formed within 10 days after receiving the application review group to apply for registration of export production enterprises on-site assessment.
Article 35 The review team should review on-site inspection and quarantine directly under the end of time to submit evaluation report.
Article 36 Inspection and Quarantine Bureau directly under review received the report, should be made within 10 days, respectively, the following decisions:
(A) the accredited qualified to be registered, issued the "export feed production, processing, storage business registration certificate, Inspection and Quarantine" (hereinafter referred to as "Registration Certificate"), since the registration made within 10 days from the date of the decision, served on the applicant;
(B) accredited unqualified, issued by the "export feed production, processing, storage business registration has not been approved quarantine notice."
Article 37, "Registration Certificate" from the date of issue, valid for 5 years.
Belong to the same business, located in different locations, with separate production lines and quality management system of export production enterprises should apply for registration, respectively.
Every registered export producers to use a registration number. The registration of export production enterprises registered number specifically dedicated plant.
Article 38 The export production enterprises to change corporate name, legal representative, product variety, production capacity, it shall within 30 days after the change in writing to the local inspection and quarantine directly under the application, fill out the "export feed production, processing, storage companies test quarantine registration application form "and submit changes to the content-related information (in triplicate).
Change the corporate name, legal representative, Inspection and Quarantine Bureau directly under review by the relevant information directly to process the change.

Section Inspection and Quarantine

(B) bilateral agreements, protocols, memoranda;
(C) the Chinese laws and regulations, mandatory standards and regulations of the State Administration of Quality Supervision, Inspection and Quarantine requirements;
(D) trade contract or letter of credit specified quarantine requirements.
Article 43 of the feed prior to export, the owner or agent shall inspection and quarantine institution to the place of origin, and provide trade contracts, letters of credit, "Registration Certificate" (copy), factory and other documents to prove eligibility. Article 44 After receiving inspection, inspection and quarantine agencies in accordance with the following provisions-the-spot inspection and quarantine:

(B) check the label: label compliance requirements;
(C) sensory examination: packaging, container is intact, with or without spoilage, whether carrying pests, with or without soil, animal carcasses, animal waste and so on.
Article 45 The inspection and quarantine institutions of different types of export production from the company's products inspection and quarantine in accordance with the appropriate regulatory model sample, issued by the "pumping / sampling certificate" sent to the laboratory for testing safety and health programs.
Article 46 The competent inspection and quarantine, inspection and quarantine agencies issued "Customs Clearance of export goods" or "export goods replacement vouchers", inspection and quarantine certificates and other relevant certificates; inspection and quarantine failed, the effective way to deal with and re-inspection and quarantine qualified, in accordance with regulations issued by the relevant documents, to be released; no effective way to deal with, or despite treatment still failed to re-inspection and quarantine, shall not be released, and issue a "failure notice and exit of goods."

Supervision and Management Section
Article 49 to obtain registration of export feed production, processing enterprises shall observe the following requirements:
(A) the effective operation of the self-controlled system;
(B) the importing country or region in accordance with the standards or requirements of the contract manufacturing of export products;
(C) to comply with our regulations regarding drugs and additives, shall not be stored, used or region of China and importing countries prohibit the use of drugs and additives;
(D) export feed packaging, loading and transport containers shall meet the health and safety requirements. Label shall comply with the import requirements of the relevant country or region. Shall be indicated on the label or packaging manufacturer name or registration number, product use;
(E) the establishment of corporate files, records the production process of raw materials used in the name, number (weight) and their suppliers, raw material inspection, semi-finished products and self-controlled, storage, a library, export, pest control, product recalls, etc., save the log file at least 2 years;
(F) fill out the "export control manual feed", recording the inspection and quarantine institutions supervision, sampling, inspection, foreign official institutions as well as annual visits and so on.
To obtain registration of feed businesses should set up an enterprise storage files, records stored feed name, number / weight of cargo, storage, a library, a pest control situation, the log file kept for at least 2 years.
Article 50 The inspection and quarantine authorities within the jurisdiction of registration of export production enterprises daily supervision and management, including:
(A) environmental health;
(B) pest control measures;
(C) the hazardous substances the effectiveness of self-controlled;
(D) raw materials or suppliers change their situation;
(E) packaging, bedding materials and finished products;
(F) production equipment, appliances, transport safety and health;
(G) batches and label management;
(H) other content related to health and safety;
(I) "Export control manual feed" record case.

Article 55 The export inspection and quarantine institutions at home and abroad feed is detected disease, toxic or other hazardous substances exceeding the quality of health and safety issues, inspection and quarantine institutions to verify the situation, the implementation of the tightened inspection and quarantine regulatory measures.
Article 56 registration of export manufacturing enterprises and export enterprises found that the record production and business-related products may be contaminated and affect feed safety, or their export products in foreign countries when the suspected cause feed safety incidents should be reported within 24 hours local inspection and quarantine authorities, and to take control measures to prevent substandard products to the factory. Article 57 has been registered export producers, one of the following occurs, withdraw from the Inspection and Quarantine Bureau directly under the registration:

(C) the annual unqualified.
Article 58 of the following circumstances, Inspection and Quarantine Bureau directly under the interested party's request or under the basis of authority, may revoke the registration:
(A) Immediate Inspection and Quarantine staff abuse of power, dereliction of duty to grant the registration;
(B) beyond the statutory authority to grant registered;
(C) the violation of legal procedures to grant registered;
(D) do not have or do not meet the statutory eligibility criteria to grant export production enterprises registered;
(E) the registration may be revoked in other cases.
Export production enterprises to fraud, bribery or other improper means to obtain the registration, it shall be revoked.
Article 59 of the following circumstances, Inspection and Quarantine Bureau directly under the registration shall apply for the cancellation:
(A) the registration does not extend the expiry date;
(B) the termination of export production enterprises according to law;
(C) the business due to discontinued, conversions, closures and other reasons no longer engaged in the export feed business;
(D) the registration shall be revoked, withdrawn or revoked;
(E) due to force majeure registration matters can not be implemented;
(Vi) laws and regulations should be written off registration in other cases.
Chapter border inspection and quarantine
Article 60 The transit transport feed, carrier or escort shall hold bills of lading and the exporting country or a certificate issued by regional authorities, to the port of entry inspection and quarantine institution, and written submissions of transit transport routes.

Chapter VI Legal Liability
Article 64 of the following circumstances, the inspection and quarantine agencies in accordance with "the State Council on strengthening food and product safety supervision and management of special provisions" shall be punished:
(A) the storage, use or import of our country or region prohibit the use of drugs, additives and other raw materials in;
(B) a non-registered feed production, processing and production of products posing as export production enterprises registered products;

Chapter VII Supplementary Provisions

Factory Certification: refers to the registration of export feed or feed additives, processing enterprises issued to prove that their products through the enterprise system self-controlled file assessed as qualified.
Article 70 These Measures shall be interpreted by the AQSIQ.
